Nuonda respects intellectual property rights and expects its users to do the same. We respond to clear notices of alleged copyright infringement that comply with the U.S. Digital Millennium Copyright Act (DMCA) and equivalent laws.
1. Reporting infringement (takedown notice)
If you believe content on Nuonda infringes your copyright, send a written notice to our designated agent at dmca@nuonda.studio. To be effective, your notice must include:
- Your physical or electronic signature.
- Identification of the copyrighted work you claim has been infringed.
- Identification of the material that is claimed to be infringing, with enough detail for us to locate it (e.g. a URL or account).
- Your contact information (name, address, telephone number, and email).
- A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.
- A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner’s behalf.
Note that under Section 512(f) of the DMCA, anyone who knowingly materially misrepresents that material is infringing may be liable for damages.
2. Designated agent
Notices should be sent to our designated copyright agent:
Nuonda Copyright Agent
Email: dmca@nuonda.studio
3. What we do with a valid notice
When we receive a complete and valid notice, we will remove or disable access to the allegedly infringing material and, where appropriate, notify the user who provided it.
4. Counter-notice
If you believe your material was removed by mistake or misidentification, you may send a counter-notice to dmca@nuonda.studio including:
- Your physical or electronic signature.
- Identification of the material that was removed and the location where it appeared before removal.
- A statement under penalty of perjury that you have a good-faith belief the material was removed as a result of mistake or misidentification.
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the appropriate court and will accept service of process from the party who filed the original notice.
If we receive a valid counter-notice, we may restore the material in accordance with the DMCA unless the original complainant files a court action seeking to restrain the activity.
5. Repeat infringers
We will, in appropriate circumstances, suspend or terminate the accounts of users who are repeat infringers.
6. A note on outputs you create
Outputs you generate from your own uploads belong to you (see our Terms). You are responsible for ensuring you have the rights to the material you upload and process. Nuonda does not offer features to replicate a specific artist’s style or identity.
